OVERVIEW - ACADEMIC MISCONDUCT REGULATIONS

Student academic misconduct procedures are specified in Chapter UWS 14 and the UWM implementation provisions (Faculty Document 1686). A combined set of these UW System and UWM procedures is attached.

Academic misconduct is an act in which a student seeks to claim credit for the work or efforts of another without authorization or citation, uses unauthorized materials or fabricated data in any academic exercise, forges or falsifies academic documents or records, intentionally impedes or damages the academic work of others, engages in conduct aimed at making false representation of a student's academic performance, or assists other students in any of these acts.

Prohibited conduct includes cheating on an examination; collaborating with others in work to be presented, contrary to the stated rules of the course; submitting a paper or assignment as one's own work when a part or all of the paper or assignment is the work of another; submitting a paper or assignment that contains ideas or research of others without appropriately identifying the sources of those ideas; stealing examinations or course materials; submitting, if contrary to the rules of a course, work previously presented in another course; tampering with the laboratory experiment or computer program of another student; knowingly and intentionally assisting another student in any of the above, including assistance in an arrangement whereby any work, classroom performance, examination or other activity is submitted or performed by a person other than the student under whose name the work is submitted or performed.

An instructor who believes a student has engaged in academic misconduct first discusses the matter with the student. Following the meeting, if the instructor concludes that misconduct occurred, the instructor may impose a sanction of reprimand, a repeat assignment, lower or failing grades for the assignment or course, or removal from the course. All sanctions may be appealed to a hearing committee.

An instructor who considers the misconduct to be serious enough to warrant probation, suspension or expulsion makes such a recommendation to the appropriate investigating officer (IO) who is an appointee of the dean in the student's school or college. If after discussions with the student the IO agrees with the instructor's recommendation, a hearing is scheduled before the academic misconduct hearing committee corresponding to the students status (undergraduate or graduate). Relative to such hearings students have a right to a written notice of the alleged offense and sanction sought, to question adverse witnesses, to be heard and present evidence, to be represented and obtain a record of the hearing at student expense and to a written decision and a copy of all applicable procedures. Students who are suspended or expelled by a hearing committee may appeal to the Chancellor.

Suspensions and expulsions bar enrollment at any campus in the UW System. Students may petition for readmission after half of the suspension period, in the case of suspensions, or one year in the case of expulsions.

Records of all disciplinary actions are maintained by the Dean of Students.

INSTRUCTOR RESPONSIBILITIES

Instructor Responsibilities

"Instructor means the faculty member or instructional academic staff member who has responsibility for the overall conduct of a course and ultimate responsibility for the assignment of the grade for the course." [14.02(ii)] For the purposes of Chapter 14, the administrator of a testing program or his/her supervisor performs functions comparable to those of an instructor if alleged misconduct occurs during the administration of placement or proficiency testing.

1. Suspects academic misconduct.

2. Contacts investigating officer of school or college in which student is enrolled for assistance and advice.

3. Instructor promptly offers to discuss matter with the student. If as a result of the discussion the instructor determines that no academic misconduct occurred, the process ends.

4. If the instructor determines that academic misconduct did occur, the instructor, in consultation with the investigating officer, chooses or recommends an appropriate sanction, from the following:


a. Group A Sanctions (oral reprimand, written reprimand to student only, assignment to repeat the work, to be graded on its merits).

1) Sanction imposed by instructor.

2) Instructor not required to inform student of right to a hearing.

b. Group B Sanctions (lower or failing grade on the particular assignment or test, a lower grade in the course, a failing grade in the course, removal of the student from the course in progress, personal probation, a written reprimand to be included in the students disciplinary file).

1) The instructor prepares a written report as follows:

a) a description of the Misconduct

b) specification of the sanction recommended

c) notice of the student's right to request a hearing before the academic misconduct hearing committee, and attaches UWM Faculty Document 1686

2) The written report is delivered to the student or is mailed to the student by regular first class U.S. mail at his or her current address as maintained at the institution. Copies are sent also to the investigating officer, the student affairs officer, and the Dean of Students.

c. Group C Sanctions (disciplinary probation, suspension, or expulsion)

1) Instructor prepares written report as follows:

a) a description of the misconduct

b) specifications of the sanction recommended.

2) The report is sent to the investigating officer.

3) The instructor will be called upon to meet with the investigating officer.

d. Hearing

1) If a hearing is held, the instructor may be a witness, but is not responsible for conducting the hearing. The instructor would be expected to present evidence supporting the imposition of sanctions he/she recommends.

Investigating Officer Responsibilities

"The Dean of each school and college shall appoint an investigating officer who shall have jurisdiction over students enrolled in that school or college. In the case of degree and non-degree candidates not enrolled in schools or colleges, the investigating officer of the academic unit offering the course in which the alleged misconduct occurred will have jurisdiction. The investigating officer of the College of Letters and Science shall have jurisdiction in the event a degree or non-degree candidate not enrolled in a school or college is alleged to have committed an act of academic misconduct outside the context of a course 14.02(12)."

1. Distributes all information and procedures on academic misconduct (UWS Chapter 14 and UWM Faculty Document 1686) to faculty, instructional staff, and professional staff within the school or college.

2. Provides advice and consultation to instructors on issues of academic misconduct, and consults with other investigating officers, the student affairs officer, and/or the Dean of Students as necessary.

3. Assists instructor in preparing a report when Group B sanctions or Group C sanctions are recommended.

4. Receives report prepared by instructor when Group B or C sanctions are recommended. May meet with instructor or student at any time during the proceedings.

5. The investigating officer may proceed subject to hearing rights to impose disciplinary sanctions (including removal of the student from the course in progress, personal probation, a written reprimand to be included in the student's disciplinary file, disciplinary probation, or suspension or expulsion from the university) when he or she receives information that a student enrolled in the school/college has engaged in alleged academic misconduct and

a) Some or all of the alleged academic misconduct occurred outside the scope of any course for which the involved student is currently registered;

b) The involved student has previously engaged in academic misconduct subject to the disciplinary sanctions listed in s. UWS 14.04 (1) (d) through (j);

c) The alleged misconduct would, if proved to have occurred, warrant a sanction of disciplinary probation, suspension or expulsion; or

d) The instructor in the course is unable to proceed.

6. The investigating officer's procedure is as follows:

a. offers to discuss the allegation with the student. The purpose of this discussion is to permit the investigating officer to review with the student the bases for his or her belief that the student engaged in academic misconduct, and to afford the student an opportunity to respond.

b. discusses the matter with the instructor, either before or after the conference with the student.

c. determines:

1) no academic misconduct occurred, end of process

2) academic misconduct occurred. The investigating officer prepares a report specifying

a) a description of the misconduct

b) specification of the sanctions recommended

c) notice of the student's right to a hearing before the academic misconduct hearing committee, along with a copy of UWM faculty document 1686.

3) The written report is delivered in person or by first class U.S. mail to the student, and is also sent to the instructor and the student affairs officer.

7. If a hearing is held, the investigating officer may be a witness, but is not responsible for conducting the hearing. The investigating officer would be expected to present evidence supporting the imposition of sanctions he/she recommends.
